This End User License Agreement ("Agreement") governs your use of the Garage Minder app ("the app"), an independent app published by DowneyTech ("the developer"). By downloading or using the app, you agree to this Agreement. The app is licensed, not sold, to you.
The developer grants you a personal, non-transferable, non-exclusive license to use the app on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions and the Apple Licensed Application End User License Agreement, which apply to this app and are incorporated into this Agreement. Where this Agreement and Apple's terms conflict, Apple's terms govern to the extent of the conflict.
The app is free to use for one vehicle with every feature included. Garage Minder Pro unlocks unlimited vehicles and is offered through Apple's In-App Purchase system as either:
For the auto-renewable subscription: payment is charged to your Apple Account at confirmation of purchase. The subscription automatically renews for the same one-year period at the same price unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription, and turn off auto-renewal, in your Apple Account settings at any time after purchase. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
Your use of the app is also governed by our Privacy Policy. In short, the app has no server of its own, collects no analytics, shows no ads, and does not sell or share your data; the data you enter stays on your device and in your own private iCloud database.
You agree not to reverse engineer, decompile, or attempt to derive the source code of the app except to the extent permitted by law, and not to use the app in any unlawful way. Maintenance schedules, fluid specifications, and suggestions generated in the app are a starting point only and are not a substitute for your vehicle's owner's manual or professional advice; always verify them before performing or skipping any service.
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that the app will be uninterrupted or error-free, or that any information it generates is accurate or complete.
To the maximum extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the app. This does not limit any liability that cannot be excluded under applicable law.
This Agreement is between you and the developer only, not with Apple. Apple has no obligation to provide any maintenance or support for the app. Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement and may enforce it against you. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you.
This license is effective until terminated. Your rights under it end automatically if you fail to comply with any of its terms. You may end it at any time by deleting the app. Cancelling a subscription ends its renewal but does not, by itself, delete the app or your data.
If this Agreement changes, the updated version will be posted on this page with a new date. Your continued use of the app after a change takes effect means you accept the updated terms.
